OCCORRONO PERMESSI PER LE VETRATE?

Le vetrate scorrevoli e impacchettabili non sono dei serramenti e sono facilmente amovibili, cioè rimovibili o smontabili manualmente ed in pochissimo tempo. Sono realizzate con ante in vetro monolitico (senza camera d’aria) e prive di telai perimetrali che non alterano l’aspetto architettonico della struttura.
Proprio per queste sue caratteristiche, l’installazione delle vetrate non necessita di autorizzazione (salvo diversa disposizione che può cambiare da comune a comune) perché “non alterano le sagome originali e gli aspetti architettonici, visivi ed estetici dei partiti edilizi, dei prospetti, retro-prospetti e facciate su cui sono poste”, come stabilito da numerose Sentenze di Legge.

Lo ha chiarito il T.A.R. Piemonte, sez. II, con la sentenza n. 18 del 7 gennaio 2020.

Il caso. Sono stati installati dei semplici pannelli trasparenti frangivento scorrevoli su un terrazzo privato senza alcuna pratica edilizia e per questo è stata adottata un’ordinanza di demolizione dal comune di Torino ritenendo la struttura abusiva. L’interessato, contro questo provvedimento e con successo, ha proposto ricorso evidenziando la particolare precarietà del manufatto. Nella sentenza viene specificato che negli atti del comune non vi è però alcuna precisazione sulle caratteristiche costruttive dell’intervento limitandosi a specificare una “chiusura di due balconi (…) con struttura composta da pennelli che scorrono su guide”. Dunque, prosegue il collegio, agli atti non compare alcuna precisazione utile ad assimilare il manufatto ad una veranda disciplinata dal regolamento edilizio e necessitante di una licenza ovvero ad una semplice tenda che non richiede alcuna autorizzazione.
